Green Lantern Pizza is a food service business operating in the United States. Through our Site and associated channels, we offer the following services:

4. User Obligations and Prohibited Activities

As a condition of your use of the Site and our services, you agree to comply with all applicable federal, state, and local laws, regulations, and ordinances. You further agree that you will not engage in any of the following prohibited activities:

4.1 General Prohibited Activities

• Using the Site for any unlawful purpose or in violation of any applicable law or regulation;
• Engaging in fraudulent activity, including but not limited to submitting false orders, using stolen payment information, or misrepresenting your identity;
• Attempting to gain unauthorized access to any portion of the Site, other user accounts, or the Company's systems or networks;
• Transmitting any viruses, malware, spyware, or other harmful or destructive code through the Site;
• Interfering with or disrupting the integrity or performance of the Site, its servers, or networks;
• Using automated tools, bots, scrapers, or similar technologies to access, collect, or harvest data from the Site without our express written consent;
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of any portion of the Site;
• Engaging in any activity that places an unreasonable or disproportionate burden on our Site's infrastructure;
• Collecting, harvesting, or storing personal information about other users without their explicit consent;
• Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity;
• Posting, transmitting, or sharing any content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable;
• Using our Site or services to send unsolicited commercial communications (spam); or
• Facilitating or encouraging any third party to engage in any of the foregoing activities.

4.2 Order-Specific Obligations

• You agree to provide accurate delivery address information, contact details, and any special instructions when placing an order;
• You agree to be available to receive your order at the specified delivery location and time;
• You acknowledge that certain products, including alcoholic beverages where offered, may require age verification upon delivery or pickup, and you agree to provide valid government-issued identification as required by applicable law; and
• You agree not to place fraudulent orders or to abuse any refund, cancellation, or promotional policies.

5. Intellectual Property Rights

All content available on or through the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall design and layout of the Site (collectively, "Content"), is the exclusive property of Green Lantern Pizza or its content suppliers and is protected by United States federal and state intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable trade secret laws.

The Green Lantern Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Green Lantern Pizza or its affiliates or licensors. You may not use such marks without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial use for the purpose of ordering food and using our services. This license does not include:

• Any resale or commercial use of the Site or its Content;
• Any collection or use of product listings, descriptions, or prices for any secondary purpose;
• Any derivative use of the Site or its Content;
• Any downloading or copying of account information for the benefit of another merchant or company; or
• Any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use of the Site's Content will immediately terminate the limited license granted by us, and may subject you to civil and criminal liability under applicable intellectual property laws.

6. Payment Terms

When you place an order through our Site, you agree to pay all charges associated with your order, including the price of the food items, applicable taxes, delivery fees, service charges, and any tips you choose to add (collectively, "Order Total").

6.1 Accepted Payment Methods

We accept various forms of payment as indicated on the Site at the time of checkout, which may include major credit cards (Visa, MasterCard, American Express, Discover), debit cards, and other digital payment methods. All payment transactions are processed through secure, third-party payment processors.

6.2 Authorization and Charges

By submitting your payment information, you authorize Green Lantern Pizza and its designated payment processors to charge the applicable Order Total to your selected payment method. You represent and warrant that you have the legal right to use the payment method provided and that the payment information you provide is accurate and complete.

6.3 Pricing and Taxes

All prices displayed on the Site are in U.S. dollars and are subject to change without notice. Applicable federal, state, and local sales taxes will be calculated and added to your Order Total at checkout. Green Lantern Pizza reserves the right to correct any pricing errors, even if payment has already been processed, in which case we will notify you and either cancel your order or offer you the opportunity to confirm at the corrected price.

6.4 Refunds and Cancellations

Refund and cancellation policies vary by location and circumstance. If you are unsatisfied with your order or believe there has been an error, please contact us promptly at [email protected]. We will evaluate each request on a case-by-case basis. Refunds, if approved, will be issued to the original payment method within a reasonable timeframe, subject to applicable banking processing times. Once an order has been prepared or is out for delivery, cancellation may not be possible.

6.5 Promotional Codes and Discounts

Promotional codes, coupons, and discounts are subject to specific terms and conditions disclosed at the time of the promotion, are non-transferable, have no cash value, and may not be combined with other offers unless expressly stated. We reserve the right to void, suspend, or discontinue any promotional offer in our sole discretion.

7. Disclaimers and "As-Is" Basis

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, SERVICES, PRODUCTS, AND FEATURES OFFERED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

GREEN LANTERN PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT ON THE SITE, INCLUDING MENU DESCRIPTIONS, NUTRITIONAL INFORMATION, ALLERGEN INFORMATION, PRICES, AND AVAILABILITY; AND
• WARRANTIES THAT DEFECTS IN THE SITE WILL BE CORRECTED.

Allergen and Dietary Information Disclaimer: While we strive to provide accurate information regarding ingredients, allergens, and nutritional content, we cannot guarantee that menu items are free from allergens or cross-contamination. Customers with food allergies or dietary restrictions should contact us directly before placing an order to discuss their specific needs. Green Lantern Pizza shall not be liable for any allergic reactions, dietary issues, or health consequences resulting from the consumption of our products.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE FEDERAL TRADE COMMISSION ACT AND APPLICABLE STATE CONSUMER PROTECTION LAWS, GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
• PERSONAL INJURY OR PROPERTY DAMAGE;
• UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN;
• INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE;
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE TRANSMITTED BY THIRD PARTIES THROUGH THE SITE; OR
• ANY ERRORS OR OMISSIONS IN ANY CONTENT ON THE SITE,

ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GREEN LANTERN PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some states do not allow the limitation of liability for personal injury or incidental or consequential damages, so the above limitation may not apply to you in whole or in part. In such states, our liability shall be limited to the fullest extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service;
• Your use of the Site or our services, including but not limited to any orders you place;
• Your violation of any applicable law, regulation, or ordinance;
• Your violation of any third-party rights, including intellectual property rights and privacy rights;
• Any content you submit, post, transmit, or make available through the Site;
• Your fraudulent, abusive, or otherwise unlawful use of the Site; or
• Any misrepresentation made by you.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Our Privacy Policy describes how we collect, use, disclose, and protect your personal information. To the extent our services are offered to residents of California, we comply with the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA), as described in our Privacy Policy, including your rights to know, delete, correct, and opt-out of the sale or sharing of your personal information.

11. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Green Lantern Pizza. We have no control over, and assume no responsibility for, the content, privacy policies, practices, or terms of any third-party websites or services. You acknowledge and agree that Green Lantern Pizza shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such third-party content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit. Our inclusion of any third-party link does not imply endorsement, approval, or sponsorship of such third-party website or service.

12. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Green Lantern Pizza's primary place of business is located, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the federal and state courts located in the United States.

These Terms shall also be subject to applicable federal laws, including:

• The Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive acts and practices;
• The Computer Fraud and Abuse Act (18 U.S.C. § 1030);
• The Electronic Communications Privacy Act (18 U.S.C. §§ 2510–2523);
• The Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.; and
• All other applicable federal and state consumer protection statutes and regulations.

You hereby consent to personal jurisdiction and venue in such courts and waive any objection to the exercise of jurisdiction over you by such courts and any objection to venue in such courts.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact Green Lantern Pizza at [email protected] and provide a written description of your dispute, the relief you seek, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If the dispute cannot be resolved informally within this period, either party may pursue formal dispute resolution as set forth below.

13.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT OR CLAIMS FOR INJUNCTIVE OR OTHER EQUITABLE RELIEF TO PROTECT INTELLECTUAL PROPERTY RIGHTS, YOU AND GREEN LANTERN PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF THE SITE OR SERVICES, SHALL BE RESOLVED BY BINDING ARBITRATION.

The arbitration shall be conducted by a recognized arbitration organization (such as the American Arbitration Association (AAA) or JAMS) in accordance with its then-current Consumer Arbitration Rules. The arbitration shall take place in the United States, in a location mutually agreed upon by the parties or as determined by the arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND GREEN LANTERN PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of the arbitration section shall be null and void.

13.4 Waiver of Jury Trial

TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO ARBITRATION, YOU AND GREEN LANTERN PIZZA HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION, PROCEEDING, OR CLAIM.

13.5 Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

14. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you access or use the Site or our services. We reserve the right, in our sole discretion, to:

• Terminate or suspend your access to the Site, your account, or our services at any time, with or without notice, for any reason, including but not limited to your violation of these Terms;
• Remove or disable any content you have submitted to the Site;
• Pursue any other remedy available to us under applicable law; and
• Terminate the Site or any portion thereof at any time without notice.

Upon termination for any reason:

• Your right to access and use the Site shall immediately cease;
• Any outstanding payment obligations you have to us shall survive termination;
• We may, but are not obligated to, delete your account and all associated data; and
• All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations incurred prior to termination.

15. Changes to Terms of Service

Green Lantern Pizza reserves the right to modify, amend, or update these Terms of Service at any time and at its sole discretion. When we make material changes to these Terms, we will notify you by:

• Posting a notice on the Site's homepage or other prominent location; and/or
• Sending an email notification to the address associated with your account (if applicable).

Your continued use of the Site or our services after any such modifications constitutes your binding acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue your use of the Site and our services immediately.

Changes to these Terms will not apply retroactively to disputes arising before the effective date of such changes, except to the extent required by applicable law.

16. Severability

If any provision of these Terms of Service is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unlawful, unenforceable, or void under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision of these Terms, which shall remain in full force and effect. The parties agree that the court or arbitrator shall endeavor to give effect to the parties' intentions as reflected in the provision found to be invalid or unenforceable.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or agreements published on the Site, constitute the entire agreement between you and Green Lantern Pizza with respect to your use of the Site and our services, and supersede all prior and contemporaneous communications, negotiations, representations, understandings, and agreements, whether oral or written, between you and Green Lantern Pizza regarding such subject matter.

No waiver by Green Lantern Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure of Green Lantern Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Force Majeure

Green Lantern Pizza shall not be liable for any delay or failure to perform its obligations under these Terms arising from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, strikes or labor disputes, power outages, internet service interruptions, civil unrest, terrorism, war, or supply chain disruptions. In such events, we will use commercially reasonable efforts to resume normal operations as quickly as practicable.

19. No Agency or Partnership

Nothing in these Terms of Service shall be construed to create any agency, partnership, joint venture, employment, or franchise relationship between you and Green Lantern Pizza. You do not have the authority to bind Green Lantern Pizza in any way, and you agree not to represent yourself as an agent, employee, or partner of Green Lantern Pizza.

20. Assignment

You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without the prior written consent of Green Lantern Pizza. Any attempted assignment in violation of this provision shall be null and void. Green Lantern Pizza may freely assign these Terms or any of its rights and obligations hereunder without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

21. Electronic Communications

By using the Site and our services, you consent to receive communications from us electronically, including via email and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that your electronic consent and acknowledgment of these Terms has the same legal effect as a physical signature.
